Can't Get Drivers License!!!!!!

Excuse the re-post, new at this...

But anyway, wanted to expand facts a little more at risk of repeating:

My wife (been married 1 year and waiting AOS) went to get her license (South
Carolina) and was told K1 visa are not accepted and can't even take the test. Even
had EAD, passport, birth cert, SS card, everything, still would not let her even take
the test. Says she can not get a drivers license until she gets green card.

We were told that most states were changing to this.

The DMV apparently does what they want ..they quote the law as saying" only work visa
and student visa can get DL" in SC!!!!!!!!!!

K-1 Is not recognized until she getsl green card.

Have called everyone at DMV including headquarters and was told the same - just
changed ruleslast week.

I am in the process of sueing DMV and it is costing me everything I have, but feel it
is the principle.

Even the state Attorney General states"South Carolina will "lead the nation in the
fight against illegal immigration" but the state is tramping on us trying to be
honest in the process!!

If you are on a K-1, DON'T MOVE TO SOUTH CAROLINA!!!!!!!!!!!

If fact-I recommend to ANYONE-don't move here!

Also, for those that say just move elsewhere-I plan to-but not until I have cost the
state in as much legal fees as I can...

PISSED IN CAROLINA...

Oh no what next? First we get Texas Service Center, then Bombay Consulate NOW we are going to have to deal with South Carolina? I checked the DMV web sites and so far the changes have not been posted. He comes next week. Already he has a job offer and we had planned on car shopping asap, but what good will that do if he cant't drive it? We would like to talk to you about this. What city are you in? I would contact:

a) The local media. Sounds like a good story, anything remotely linked to
9/11 seems to be picked up on and I think overreaction would work.

b) Your state representatives.

Yes it is true. We have been properly denied his obtaining a drivers license/beginners permit here in SC. The webpages for DMV do not state the law as of yet.

He got to the DMV desk with K1 visa in passport(unexpired I94), SS number, EAD, birth certificate, proof of residency as specified on their website (bills in name). They took his passport to the back and returned with the news that they don't give licenses to "these kind" of visa holders.

We asked for the reason and she said he has a visa that does not permit driving. We then inquired where this is stated, off we went to the back room to talk to supervisor (here i will agree with the ignorant attitude of carolinians). What a conversation! First of all she asks if we met on the internet. When we asked for the reason for denial she merely writes the numbers 56-1-40 on a scrap of yellow paper, and says "law". When asked where we might read this "law" she says "try the library". And by the way he did pass the library card requirment for residence.

After a bit more prodding she pulled a 2 inch "blue book", SC Criminal & Motor Vechile Laws, from her shelf and opened to 56-1-40. Which states under the "exclusions" section, which reads....

"(7) who is not a resident of SC, except for persons from other countries who are present in SC on a student or work visa or the dependants of student or worker who may be issued a license." When asked if she would make us a photocopy of this, she says "it is two pages". What? Carolinian photocopiers can't handle two page copies? And look at the wording of that exclusion. Even the dependants of a worker or student can get a license, but not the dependants of a citizen? Looks, like a knee jerk reaction law, or ignorance?

i did notice a paper taped to her office door that said Canadians may be eligible. When i asked about this, her reply was "Canadians don't need a visa to enter the country."

To top it off this woman said, "well a fiance visa is a "visitor visa". You are supposta come here, marry and go home." Sure.

How degrading. The way the law is currently reading he cannot get a drivers license until he is holding his green card. Which, by Udall's and Murthy's site is 666 days (fundamentalist's here should love that number).

His posistion at the University starts in January. Public transport in our area is nil, and he can't belive my $700 bike does not even have a kickstand. We were poised to put money into the ecomomy by purchasing a new car.

This is an insult to a man who is here to raise and support a family. Congessman Demint and Stom Thurmond here we come again.

Hit the congressmen and hard and you should get this rectified. Is there a chance he
could cross the state line and get the DL in an adjacent state perhaps, since you are
obviously living in a state of idiots (just joking)? Is there a possibility that the
employer would provide a letter confirming his employment that you could also use to

I take it he has a valid license from his own country. Let him continue using this. Or go the international driver's license route until you get some results from our elected officials.

BTW did you correct their misinformation regarding the K-1 visa holder coming to the US, getting married and having to return home? Think this might be the crux of the problem in the DMV office. They are unaware of the full rules and regulations of this particular type of visa. Perhaps you should forearm yourself with the complete INS regulation for the K-1 before you get the elected official involved.

Here we go again! ... I was poised to use my UK issued international drivers permit
but was informed out here on the news group that it wouldnt be any good as many
insurers wouldnt honour a claim if i had an accident while driving with it. Still
mighty hacked off that there will be obstacles put in my way to obtain US drivers
license when driving regulations, conditions and test are all much harder in the UK

Has anyone gotten pulled over or questioned with one? And how long does it take to
get it once you submit payment ???

Hi there Inernational driving permits in the UK are available through the RAC at a
cost of £4.00. I found this out after phoning the DVLC, it does seem kinda strange to
me that the DVLC are the only ones who can issue a driving license but not an
international permit.

Absolutely. It's quite clear that if the DMV say you are a visitor you can obviously
continue to use your foreign driving license. Unforunately there is also insurance to
consider

I'd already looked up the law a few weeks ago. It says student and work visas only -
everyone else must be a GC holder or US citizen. That's what happens when states draw
up laws based on a poor understanding of a federal agency.

IMHO, the least that SC can do is grant authorization to those with EAD cards as
other states allow.

My husband (then fiance) from Korea got pulled over in Illinois over the summer with
an International Drivers License (for blowing a stopsign, something they don't have
in Korea!) The officer took it without a problem, actually seemed more sympathetic
since he was from so far away & didn't even give him a warning! The only trouble we
had was getting car insurance - State Farm wouldn't issue insurance in his name until
he had an Illinois license.

Im confused to be honest,Ive just had a shit day down at the DMV meself so I know how
ignorant they can be - However - The DMV had a similar issue with meself,Ie,They
stated that im not a "resident" etc etc - I threw my toys out the pram to be
honest,Got my attorney on the fone to the manager,Got the DMV supervisor on the fone
to the INS etc etc.

I cant understand this statement from yer post ;

If yer hubby isnt a resident - what is he??? I argued this today on the basis that If
I'm not a resident here(Louisiana) where am i a resident of???? The INS at New
Orleans informed the DMV that I was a pending resident,ie that I had entered legally
and was going thru the AOS process.Its rubbish to say that SC DMV aint gonna let him
drive for another 666 days!

Get yer attorney involved,Contact the INS and write to the manager of the DMV asking
what is he supposed to do in the interim? drive illegally???

I cant comment on the rest of the U.S but the general treatment of immigrants
here(LA) is appalling - If the culprits weren't so stupid i'd get really mad with it
all - I just pity their lack of intellect.

BTW - DMV stands for Dense Moronic Village-idiots

These facts are missing from all the imigration FAQs that I have read.

My wife is from a country whose DL is accepted by the USA for driving (I say that
because I think there are some that are not). I went to see about putting her on
our car insurance and after some run around I found out that she just needs to be
valid driving in the USA. Since her DL (from Panama) is legitimate in the USA
(just as I can drive down there) she will be covered by our (well my insurance),
but they also wanted her to have an international DL opn some mistaken idea that
she would be illegal driving on her Panamanian DL (which is all she needs to rent
a car in the USA).

FYI, an international DL is just a form as set by the UN which has her DL info
translated into several languages and can be issued by anyone who follows the UN
rules in printing it out, it is not issued by the country. In the USA, AAA is the
place for an American to get one, not the State or Federal government. She does not
actually need a the international DL to legally drive in the USA, but the insurance
said she needed one (and they did not need to see it).

The above information is as I learned it and I am not a lawyer. Look it up for
yourself since all the above facts are on the net.
